Our client was 18 years old with no prior criminal history. In fact, our client has developmental and learning disabilities and attends a special school based on these physical and mental issues that he deals with daily. He was at his friend’s house, a 16 year old in Cedar Grove, and they were sitting in my client’s car with the friend’s air soft gun. Most people do not even know that these types of guns (BB guns, airsoft guns, pellet guns) are illegal to possess without a proper permit just like a real firearms. These “guns” can be purchased at flea markets and sporting good stores. However, they are illegal to possess under New Jersey law without a proper firearms ID card. As a result, our client was charged with a felony for unlawful possession of a weapon and was facing 3-5 years in New Jersey State prison.
The client’s father hired us to handle the case and our firearms defense lawyers went to work. First, we were able to convince the Essex County prosecutor’s office to downgrade the gun charge to a petty disorderly persons offense for disorderly conduct and remand the case back to the Cedar Grove Municipal Court. Then, we conferenced the case with the municipal prosecutor and the police officer who issued the complaint and they graciously agreed to dismiss the case based on our client’s medical diagnosis and the circumstances of the case (it was not alleged that the gun was pointed at anyone or used in any way).
