Travis J. Tormey recently represented a client who was charged with aggravated assault in East Orange, NJ.
Aggravated assault is classified as a third degree felony. Since our client in this case faced felony-level charges, the case was sent to Essex County Superior Court in Newark.
The charges in the case stemmed from a domestic violence incident between our client and his wife. The wife, who was the only witness to the alleged offense, refused to testify against our client in court. As a result, our criminal defense attorneys were able to convince the Essex County Prosecutor’s Office to downgrade the charge to simple assault.
Since simple assault is a disorderly persons offense, the case was then remanded back to East Orange Municipal Court for disposition. Prior to trial, we reached an agreement with prosecutors to allow out client to complete 8 anger management sessions instead of being sentenced to jail. After a period of two months in which there were no other incidents involving our client, the charges were completely dismissed.
