The client was pulled over while driving through Guttenberg New Jersey and allegedly registered a blood alcohol concentration (BAC) of .13 percent, which is over the legal limit. Mr. Tormey scrutinized the discovery evidence in the case and determined that the client’s breath test readings were not admissible in Guttenberg Municipal Court. It was clear that the two breath samples provided by the client were “outside tolerance,” which meant that there was a large disparity between the readings. In other words, the breath machine may not have been working properly. In accordance with the NJ Supreme Court’s decision in State v. Chun, the municipal court judge ruled that the breath test samples were inadmissible at trial.

Mr. Tormey also argued in municipal court that the client’s field sobriety tests were inadmissible and never should been administered. The client was medically discharged from the military because of health issues with his foot. Mr. Tormey argued that the client should not have been forced to undergo field sobriety testing during the traffic stop because his medical issues prevented him for adequately performing the field sobriety tests. The Tormey Law Firm has a DWI expert, a retired NJ State Trooper, who testified that the client’s medical issues made it impossible for him to successfully complete the field sobriety tests.
