However, one thing that police failed to do was utilize a drug recognition expert (DRE) to examine the client after the arrest.
The client’s lab results ultimately showed that she had no marijuana or other illegal narcotics in her system; instead, she merely tested positive for cough syrup and allergy medication. Since prosecutors did not have a DRE evaluation to support their claims, Travis Tormey successfully challenged the DUI charges and persuaded prosecutors to dismiss all of the charges, including the criminal charges.
